Covenants, Rules, and Regulations Governing Use of University Gardens Swimming Pool

I hereby covenant and agree with the University Gardens Condominium Association, aka University Gardens Condominium Homeowners Association, aka University Gardens Homeowners Association,it's Board of Directors,and the owner of our apartment, his/her agents, heirs, assigns, and successors:  

1. I am thoroughly familiar with, and are competent to handle, all hazards and risks related to and associated with the use and enjoyment of the swimming pool and deck chairs, and I, my heirs, executors, and administrators, assume all risks attendant thereto, and relinquish and save harmless any and all claims on account thereof, including all claims for injuries, loss of life, damage to or loss of personal property, 
2. No persons shall use the pool until they have read and agree to comply with all rules and regulations governing use of the same.  There is no lifeguard on duty, therefore no one may swim alone.  Minors under the age of 18 shall be permitted to use pool, but may not swim alone and must be accompanied at all times by an authorized pool user aged at least 21, and this adult shall be fully responsible for the behavior and conduct of such minor at all times.  No infants in diapers are allowed in the pool.
3. Each authorized pool user shall be allowed to bring up to 2 guests,  provided they inform such guest of all rules and regulations, and such authorized pool user must be present at all times with their guest(s) and shall be responsible for their guest(s) safety, conduct, and behavior.  Children over 6 years old, even if they reside at University Gardens, are considered to be "guests" of the pool pass holder.   Occasional exceptions will be allowed by management upon request, such as someone having more than two children.  Pool parties with more than 2 guests are allowed, but advance permission must be obtained in writing by emailing universitygardens411@gmail.com 
4. Pool may be closed at any time due to weather, breakdown of equipment, or other reasons.  No one may be in the pool area during thunderstorms (lightning can kill you!) or after sunset.  No rent rebates can be offered if pool has to be closed for any reason or for any length of time.
5. Management has the right to suspend or revoke pool privileges for misconduct, loud or boisterous behavior, breach or failure to comply with rules and regulations, or any other reason deemed by management to be desirable for the safety and/or benefits of all residents.  
6. All persons must shower before entering pool, and may not use pool if they have any communicable diseases, whether of the skin or any other areas of their body.
7. Absolutely no pets allowed in or around the pool area. 
8. No diving is permitted.
9. Running, pushing, wrestling, ball playing or any undue disturbance in or about pool are not allowed.  Life-saving equipment (life ring and rescue pole) may not be tampered or played with.
10. Persons entering the pool area may not be intoxicated, nor may they bring in any alcoholic beverages.  By entering pool area, persons agree that any bags or containers brought in may be inspected.
11. No smoking, glass bottles, food, or chewing gum are allowed in pool area.  Plastic bottles or soda cans are acceptable provided they are disposed of in the proper containers.  You may smoke outside the pool fence, but any cigarettes that are brought must be left outside the gate.
12. No profane language or breaches of the peace allowed.    
13. Management reserves the right to refuse entry or deny pool privileges to anyone at its sole discretion. 
14. Mangement may revise and/or amend these rules at any time by notifying authorized pool users via email or notice left on their front door.
15. A 911 emergency phone is at the pool in a red box.  You must locate and familiarize yourself with the use of this phone before entering pool.  Check that the phone is there and that you get a dial tone when you enter the pool area.  If the phone is missing or you do not get a dial tone, DO NOT use the pool, and instead notify your landlord.

Once submitted, you will be given the combination to the gate.  You may not give this combination to anyone else, including any children or any roommates or family members who have not signed this agreement.  In accordance with item #3 above, you must accompany any guests, and you must have a picture ID with you so your identity can be verified.  If you want friends or guests to use the pool without your being present, email universitygardens411@gmail.com  to obtain daily or seasonal pool passes for them at a small fee.

By checking the above box, I certify that my name is on the lease for the above apartment, I have read and understood the above rules and regulations, agree to observe and comply with same at all times, and will require compliance therewith by all members of my family and guests when they accompany me.
Please submit separate form for each person on lease who wants pool access.

If you or your guests are in violation of any of these rules, either or both of the following penalties will be imposed, depending on the severity of the violation:

(a) Your pool privileges will be suspended for a time period extending up to the end of the season, and/or

(b)  A fine of up to $100 will be imposed.
